$66 million awarded in health club case.

Shocking amount of money that is hard to justify. 

A Cybex weight machine fell on top of a woman paralyzing her. The plaintiff was at work at the time of the accident. The jury found “Cybex 75 percent liable and Amherst Orthopedic Physical Therapy, where Barnhard was working when the accident occurred, responsible for 20 percent.” The plaintiff was found 5% liable.

I write a lot about the damages in paraplegic and quadriplegic cases and how they can be excessive. Damages up to $30 million dollars for young plaintiffs who were making a large amount of money are possible. However, $66 million is impossible to fathom.

  1. Normally an economist is hired to determine lost wages, etc for someone in this case. That number is reduced to a present value. Most of the time that number is $2M or so. Sometimes as high as $4M for someone making more than 200K. Medicals are usually $5M and future medicals are $5M. So you get hard numbers in a case like this of around $6 to $10M. The rest is pain and suffering.

  2. Hey, Jim… aren't there tables or formulas that they calculate how much, say, paralysis is worth over the course of a projected life expectancy? Plus pain, suffering, loss of ___________, and any other considerations (punitive, costs, etc.)? Maybe the formulas need to be adjusted… $66 mil seems like an awful lot, but if that's what the numbers crunch to….

  3. I should clarify my statement. The company who made the equipment that allegedly injured the woman was delisted from the stock exchange and will be filing BK probably. The issue is do you want weight lifting equipment? If so then some people are going to get hurt. If you want to enjoy life you have to accept some risk. If not, don't go outside, say in bed and hide.
