Recall Details

Units: About 150,000 in the United States and 11,000 in Canada

Description: The Cohort is an open frame folding clip knife with either a black or dark gray anodized aluminum handle. The tail end of the handle includes a lanyard hole. When the knife blade is fully extended, it is held in the open positon with a liner lock function. When fully extended, the overall length of the knife is about 7 inches. When closed, the knife measures about 4 inches. The knife blade is 3 inches long, weighs less than 3 ounces and has the Gerber “sword and shield” trademark in silver on the non-clip side of the blade. The Gerber name appears on the knife clip. Model numbers can be found underneath the UPC barcode on the lower right corner on the rear of the hanging blister packaging. For box packaging, the model number is found on the bottom of the box. A product date code appears on the blade, beneath the thumb stud, on the clip side of the knife. The last figure in the code is a letter, and the recall applies to all Cohort knives with the letters “E” and “F.”

Incidents/Injuries: Gerber received six reports of laceration injuries, two of which required stitches.

Cycling Sports Group Recalls GT Fury Mountain Bicycles Due to Crash, Injury Hazards

Name of Product:  GT downhill mountain bicycles

Hazard: The front wheel hub can break and cause the disc brake system to fail, posing crash and injury hazards to the consumer.

Remedy:  Repair

Consumers should immediately stop using the recalled bicycles and return them to the nearest authorized GT dealer to have the complete front wheel replaced free of charge.

Description: This recall involves all 2015 model year GT Fury Elite and GT Fury Expert downhill mountain bicycles. The recalled 2015 Fury Elite model is white with blue and red accents. The recalled 2015 Fury Expert model is metallic grey with lime green accents. The bicycles have front and rear disc brakes and come with rear shock absorbers and front suspensions. “Fury” is printed on the top tube, the GT logo is on the down tube and the chainstay. The model names are printed in small letters on the top tube of the bicycles near the word Fury.

Incidents/Injuries: Cycling Sports Group has received two reports of broken hubs. No injuries have been reported.

Sold at: Authorized GT dealers from November 2014 to March 2015 for between $3200 and $4400.

Snow Peak Recalls Japanese Axe Due to Laceration and Impact Hazards

Name of Product: Japanese Axe M

Hazard: The handle of the axe can crack, allowing the axe head to come loose, posing a laceration or impact hazard to the user or bystanders.

Description: The recalled Japanese Axe M has item number R-061 printed on the back page of the included manual. The black axe head measures 5-3/4 inches high by 4 inches wide and weighs 2 pounds. The axe handle measures 14 inches long and is made of a light colored maple. A small black snow flake (asterisk) is burnt into the handle near the hole at the end of the handle. The handle has a small hole near the end, which is used for hanging the axe. The axe was sold with a white leather holder for the axe head that attaches with a snap strap.

Description: This recall involves beach cruiser style Felt Deep Six and El Guapo model bicycles with one speed and coaster brakes.  “Felt” and “Deep Six” or “El Guapo” are printed on the bicycle’s frame. The Deep Six was sold in black cherry with white sidewall tires and the El Guapo was sold in matte black with white tires. The Deep Six has a serial number between YI31106188 and YI31106287. The El Guapo has a serial number between YI31106288 and YI31106387. The serial number is printed on the bicycle’s bottom bracket.

Incidents/Injuries: Felt Bicycles has received 26 reports of incidents with the recalled bicycles. No injuries have been reported.

Remedy: Consumers should immediately stop using the recalled bicycles and contact your local Felt bicycle dealer for a free inspection and replacement of the rear hub cog/driver.

Trek Recalls Bicycles Equipped with Front Disc Brakes to Replace Quick Release Lever Due to Crash Hazard

This is going to be the first of many from bicycle and wheel manufacturers.

Name of Product: Trek bicycles equipped with front disc brakes

Hazard: An open quick release lever on the bicycle’s front wheel hub can come into contact with the front disc brake assembly, causing the front wheel to come to a sudden stop or separate from the bicycle, posing a risk of injury to the rider.

Remedy: Replace

Consumers should stop using the bicycles immediately and contact an authorized Trek retailer for free installation of a new quick release on the front wheel. Trek will provide each owner who participates in the recall with a $20 coupon that is redeemable by December 31, 2015 toward any Bontrager merchandise.  (The coupon has no cash value.)

Description: This recall involves all models of Trek bicycles from model years 2000 through 2015 equipped with front disc brakes and a black or silver quick release lever on the front wheel hub that opens far enough to contact the disc brake (see Figures 1 and 2).  Bicycles with front quick release levers that do not open a full 180 degrees from the closed position, are not included in this recall.

Incidents/Injuries: Trek reports three incidents, all including injuries. One incident resulted in quadriplegia.  One incident resulted in facial injuries.  One incident resulted in a fractured wrist.

Incidents/Injuries: Gorsuch received three reports of the heat liners smoldering during the charging process. No injuries have been reported.

Civia Cycles Recalls Hyland Bicycles, Aluminum Civia Fenders Due to Crash Hazard

Name of Product: Hyland Bicycles and Aluminum Fenders

Hazard: The fender mounting bracket can break or bend, posing a fall hazard to the rider.

Remedy: Refund.

Consumers should immediately stop riding bicycles with the recalled fenders and contact an authorized Civia Cycles dealer to receive a $60 credit.

Recall Details

Units: About 1,000

Description: This recall includes all Civia aluminum fenders sold separately as aftermarket sets and all Civia Hyland bicycles sold with the fenders as original equipment. The recalled fenders are round, size 700c x 35mm and have the Civia logo on the front and rear sides of each fender.  Fender sets came in black, blue, green, olive, red and silver. Hyland bicycles came in blue, green, olive and red. The bikes have “Hyland” on the top tube, “Civia” on the down tube and the Civia logo on the seat tube.

Incidents/Injuries: Civia has received one report in which a consumer stated that a bracket broke and resulted in the consumer suffering a cervical spine injury and nerve damage.

Sold at: Independent bicycle retailers nationwide and online from April 2008 through March 2013 for about $60 per Civia fender set and between $1,200 and $4,500 for Civia Hyland bicycles.

SCARPA North America Recalls Ski Boots with Tronic System Due to Fall Hazard

Name of Product:  F1 EVO Ski Boots with Tronic system component.

Hazard: The Tronic system, can unexpectedly switch from ski mode to walk mode, not allowing the boot to release from the binding, posing a fall or injury hazard.

Remedy:  Refund

Consumers should immediately stop using the boots and contact SCARPA North America for a full refund.

Description: This recall involves the men’s and women’s SCARPA F1 EVO ski boots with the Tronic system component. The Tronic system locks the boot into the ski binding. The boots were sold in royal blue for men and aqua blue for women with “SCARPA” written in white letters on the lower outer side of the boot. The model name “F1 EVO” is printed on the upper right outside ankle cuff of the boots.

Incidents/Injuries: The firm has received two reports of torn knee ligament injuries following falls, when the boots failed to release from the binding.

Sold at: Authorized SCARPA dealers and retailers in the United States and Canada, including Oregon Mountain Community, REI and Skimo Co., and online at http://www.scarpa.com from October 2014 through January 2015 for about $700.

Flow Sports Inc. Recalls Snowboard Bindings Due to Fall Hazard

Name of Product: Flow 2014 Flite-series snowboard bindings

Hazard: A pin can disengage and cause the binding to open, posing a fall hazard.

Remedy: Repair, replace, refund

Consumers should immediately stop using the recalled snowboard bindings and contact Flow Sports for a free repair or to return the bindings for free replacement bindings or a full refund.

Description: This recall involves Flow 2014 Flite-series snowboard bindings with model names Flite, Haylo, Micron Youth, Flite LTD and Flite MTN. The bindings have a snaplock lever on the rear, a cable adjustment dial on the side of the baseplate, a matte texture finish on the baseplate and a glossy “Flow” and Flow’s logo on the hiback. They are black; black and white; black, white and blue; or black, white, blue and yellow. “Flow” is printed on the side of the bindings.

Incidents/Injuries: Flow Sports has received 30 reports of the pins disengaging from the bindings. No injuries have been reported.

Sold at: Dick’s Sporting Goods, EVO, SNSboards, Sport Chalet, The House, Wired Sport, Zumiez and other stores nationwide and online from July 2014 through February 2015 for between $110 and $150 for the bindings.

Incidents/Injuries: The firm has received four reports of the Aerobars bolt loosening. No injuries have been reported.

SRAM Recalls Zipp 88 Bicycle Wheel Hubs Due to Crash and Injury Hazards

Name of Product: Zipp 88 aluminum hubs for bicycle wheels

Hazard: The hub flange ring on the front hub can fail posing a crash and injury hazard.

Remedy: Replace

Units: About 12,000

Description: The aluminum hub shell is silver. The outside flange ring is gray aluminum in the standard option and blue, gold, gray, pink or red in the ZedTech options. The diameter of the two clinch nuts is approximately 1 inch. The first version of the 88 hub is the only one affected by the recall. The first version has the Z logo on the flange ring. The other versions – not affected by this recall – do not have the Z logo on the flange ring. The hubs were sold in five bike brands and sold separately. Incidents/Injuries: The company reports two incidents of collapsed front wheels. Both resulted in stitches, bruises and lacerations, plus a concussion in one case.

Remedy: Consumers should immediately stop using bicycles equipped with the recalled Zipp 88 front hub and contact SRAM for a free replacement hub.

Sold at: Specialty bicycle retailers nationwide. Front hub sold for about $215; front wheel with the hub sold for about $920; front and rear wheel set sold for about $2300 and bicycles with the wheel set containing the recalled hub sold for about $5,000 to $12,000. Items were sold between October 2008 and December 2010.

Recall: 2014 Marin MBX 50 and Tiny Trail Bicycles

Marin Mountain Bikes Inc., of Novato, Calif.

Remedy: Marin Mountain Bikes at (800) 222-7557 from 9 a.m. to 5 p.m. PT Monday through Friday, or visit the firm’s website at www.marinbikes.com and click on “Recalls/Safety” for more information.

Recall Information: The handlebars can loosen or separate during use. This can cause the rider to lose control and/or crash, posing the risk of injury.

Units: 450 in US and Canada

Marin 2014 model MBX 50 and Tiny Trail boys and girls bicycles with 16-inch knobby tires. The single speed bicycles have high-rise handlebars and training wheels.  The boy’s bicycles were sold in red and have serial number HA14980XXXXXX. The girl’s bicycles were sold in purple and have serial number HA14982XXXXXX. Serial numbers are printed on a foil label affixed to the underside of the base of the down tube. “Marin” is printed on the seat and the downtube. “Tiny Trail” or “MBX 50” is printed on the bicycles chain guard.

Retailers: If you are a retailer of a recalled product you have a duty to notify your customers of a recall. If you can, email your clients or include the recall information in your next marketing communication to your clients. Post any Recall Poster at your stores and contact the manufacturer to determine how you will handle any recalls.

Cane Creek Recalls Bicycle Shocks Due to Risk of Injury

Year Manufactured: 2014

Incidents/Injuries: Cane Creek has received four complaints from customers, one of which involved a report of injury with bruises in the midsection.

Sold: Distributors and retailers globally from May 2014 through September 2014 for about $495 each or included in the price of the bike.

Description: This recall involves Cane Creek Cycling Components DBINLINE bicycle rear shock absorbers. The shocks are marked with graphics that incorrectly identify the adjustment directions for High Speed Rebound (HSR) damping.  HSR on the shock is decreased by turning the adjuster counter-clockwise and increased by turning it clockwise. The incorrect graphics present the opposite; that is, the plus(+) and minus(–) symbols are switched. The consumer can be misled or confused when adjusting HSR on these shocks. The shocks come in black anodized aluminum with the words “INLINE” marked on the air can portion of the shock and are attached to a full-suspension mountain bike frame. Recalled products have a serial number on the underside of the top valve body in the following ranges: AA00002 – AA07304 and SA00077 – SA03926.

Hazard: The shock absorber is marked with graphics that incorrectly identify the adjustment directions for High Speed Rebound (HSR) damping. Following these directions will cause unexpected behavior by a bike’s suspension and pose a fall hazard to a rider.

Remedy: Consumers should immediately stop using the product and contact Cane Creek for a repair decal kit to correct the HSR adjustment markings on affected product.

Plaintiff crashed her bike suffering head injuries. Plaintiff was wearing a bicycle helmet that was subject to a recall, earlier. The plaintiff hoped her injury could be paid for by the helmet manufacturer using the recall as the influence with the jury.

This is why recalls are such a problem. The recalls themselves are a nightmare for the outdoor recreation industry because the problems don’t fit in the Consumer Product Safety Council (CPSC) mold. The cost goes through the roof trying to comply with the requirements of the recall and deal with the resulting bad publicity.

The biggest problem is recalls immediately show up on the plaintiff attorney’s websites with the line Have you been hurt using/wearing this product “Call us.”

In this case, the plaintiff purchased a bicycle helmet from the defendant retailer. The bicycle helmet was subject to a recall prior to the plaintiff’s crash. The plaintiff exchanged the helmet for a newer one due to the recall, prior to her crash. The plaintiff fell while riding her bike suffering head and other injuries and sued.

The first defendant was a retailer in New York. The retailer purchased the helmet from a distributor in Texas. The distributor imported the helmet from the manufacturer, a Spanish corporation. All three, the manufacturer, distributor, and retailer were defendants to the litigation. All three were in the chain of sale from the manufacturer to the consumer.

The theory behind allowing suits against everyone involved in the litigation is anyone in the chain could have spotted the defect and prevented the consumer from purchasing a defective product. That was a great theory when wagon wheels were being sold. Everyone understood wagon wheels and could see a flaw or defect in a wagon wheel before the consumer purchased the wheel.

That general theory does not work any longer in software, computers or in this case a bike helmet. If you could understand the physics and engineering behind the creation of the helmet, you could not see the defects in many cases because the defects are covered by plastic.

The suit was filed in Michigan the home state of the plaintiff in the United States District Court for the Eastern District of Michigan, Southern Division. Federal courts are the courts in place to deal with litigation between parties from different states or of the US and another country. The federal courts are not subject to the issue of “hometowning” or deciding a case solely on the issue of where the parties live in the courts’ hometown.

The three defendants filed a motion for summary judgment, which was granted.

Federal District Court decisions are reported. Very few states report trial court decisions. However, this is different in the federal system, and we have an interesting case.

Analysis: making sense of the law based on these facts.

The plaintiff dismissed its negligence and gross negligence claims and proceeded with its breach of warranty claims prior to this motion. The plaintiff stated there was no express warranty claim, only a breach of implied warranty. Implied warranties are warranties that attach to any sale. They are not written down in the manual, they occur whenever there is a sale. Implied warranty of merchantability and implied warranty of fitness for a particular purpose are warranties that go with every sale and are the two main claims in lawsuits.

These warranties are not in writing and unless disclaimed, they go with any sale. The first, warranty of merchantability means the product meets the requirements of the industry where they are sold. The implied warranty of fitness for a particular purpose is a warranty that the promises made by the sellers will be met by the product. No specific warranty was mentioned in the decision other than the warranty of fitness and merchantability. There were also allegations that there was a breach of warranty under Michigan’s law, which may be the same or different from the warranties explained above.

The plaintiff’s case was based on the recall. The CPSC required a recall “poster” which was entered into evidence as proof of the recall and the defect. The plaintiff also had an expert who opined that the plaintiff’s head injury “directly related to the inadequacies of the Catlike Kompact bike helmet.”

No other evidence was introduced. The expert’s opinion was not specific and did not provide any cause for the injury or the failure of the helmet. The court held that because there was no analysis of the crash, speed, location of impact or details of the accident the expert’s opinion was of no value.

As discussed at oral argument, plaintiff has not brought forth any evidence of the reason the Catlike Kompact helmet failed impact testing. All that has been presented is a one-page press release from the CPSC, set forth above, including a statement that “[t]he helmets fail impact testing required under CPSC’s safety standard for bicycle helmets, violating the Consumer Product Safety Act.” Without additional information from the CPSC or any other source, or the results of any independent testing, it is the opinion of the court that Dr. Kress’ statement that “[t]he severity of the head injury sustained by Ms. Jenish is a direct result of the inability of the Catlike Kompact to comply to the CPSC’s safety standards” can be nothing but inadmissible speculation.

Although warranty claims require very little evidence to prove, in this case, no evidence was presented that the court could rely upon to uphold the claims of the plaintiff. The court granted the three defendants’ motion and dismissed the case.

So Now What?

This case has little value in teaching about helmet crashes, and the liability issues involved in manufacturing helmets. What it does teach is the unintended consequence of dealing with a recall and the CPSC.  

It is impossible, probably, nowadays to create a product that will never have a recall. However, that does not mean you should try. As important, if you are looking at a recall, make sure you fully understand the consequences and work with counsel to lessen the impacts of the recall on your company and the effects it may have.

You also must disclaim all warranties other than the warranties you want for your product. If the proper disclaimer had been part of the information going with the sale of the helmet then this case would not have gone this far.

It is common for many products in the outdoor recreation industry to be brought into the US without the proper warranties and disclaimers. Additionally, many times when translating a product manual the word warranty will be translated into the word guaranty in English, which creates even greater liability issues.

OPINION

OPINION AND ORDER GRANTING DEFENDANT THE KREB CYCLE’S MOTION FOR SUMMARY JUDGMENT (DOCUMENT # 38)

INTRODUCTION

Before the court in this product liability lawsuit is a motion for summary judgment brought by defendant The Kreb Cycle, a New York seller of bicycle equipment, in which it asserts it is entitled to judgment on all counts in the complaint. 1 Because the court agrees that plaintiff has not raised a question of material fact as to causation of her injuries by an allegedly defective bicycle helmet, defendant’s motion is granted as set forth below.

BACKGROUND

Plaintiff Tracy Jenish was riding with a bicycling [*2] club on Wing Lake Road in the area of Bloomfield Hills, Michigan on September 26, 2002, when she fell off her bike and suffered serious bodily injuries, including injuries to her head. She was wearing a helmet called a “Catlike Kompact,” manufactured by defendant Catlike Sport Components SL, a Spanish corporation, distributed by defendant Monarch Velo LLC, a Texas corporation 2, and sold to the plaintiff by movant-defendant Kreb Cycle, a New York corporation.

2 Answers to the complaint by the remaining defendants have not been filed, and defendant Kreb Cycle states in its motion that the other defendants are in default. The docket reflects that a clerk’s entry of default was filed as to defendant Monarch Velo, L.L.C. on June 2, 2006.

The Kreb Cycle (hereinafter “defendant”) started carrying these helmets after its owner attended a trade show in Las Vegas, where a model of the Catlike Kompact helmet was on display. Defendant ordered the helmets from Monarch Velo LLC, d/b/a “Catlike USA,” a Texas distributor. [*3] The helmets came with the manufacturer’s label stating they complied with U.S. Consumer Product Safety Commission (“CPSC”) standards. Although there are no records of the sale, defendant does not dispute that it sold the helmet to plaintiff. Plaintiff’s recollection, according to her deposition, is that she called in with a credit card or ordered it online, at some point during the year preceding the accident.

In 2003, some months after plaintiff’s accident, the Catlike Kompact helmet was the subject of a voluntary manufacturer recall. Defendant has produced a copy of the CPSC’s announcement of this recall, which is reproduced below in its entirety, with the exception of the generic CPSC headings and contact numbers:

This action was filed in federal court on the basis of diversity of citizenship in September 2005. [*5] Plaintiff’s First Amended Complaint, filed September 29, 2005, makes a common claim against all three defendants, asserting negligence, gross negligence, and breach of warranty in the design, manufacture, and distribution of an unmerchantable, “untested” bicycle helmet that failed to protect against injury to the head.

STANDARD FOR SUMMARY JUDGMENT

Federal Rule of Civil Procedure 56(c) empowers the court to render summary judgment “forthwith if the pleadings, depositions, answers to interrogatories and admissions on file, together with the affidavits, if any, show that there is no genuine issue as to any material fact and that the moving party is entitled to judgment as a matter of law.” See Redding v. St. Eward, 241 F.3d 530, 532 (6th Cir. 2001). The Supreme Court has affirmed the court’s use of summary judgment as an integral part of the fair and efficient administration of justice. The procedure is not a disfavored procedural shortcut. Celotex Corp. v. Catrett, 477 U.S. 317, 327, 106 S. Ct. 2548, 91 L. Ed. 2d 265 (1986); see also Cox v. Kentucky Dept. of Transp., 53 F.3d 146, 149 (6th Cir. 1995).

The [*6] standard for determining whether summary judgment is appropriate is “‘whether the evidence presents a sufficient disagreement to require submission to a jury or whether it is so one-sided that one party must prevail as a matter of law.'” Amway Distributors Benefits Ass’n v. Northfield Ins. Co., 323 F.3d 386, 390 (6th Cir. 2003) (quoting Anderson v. Liberty Lobby, Inc., 477 U.S. 242, 251-52, 106 S. Ct. 2505, 91 L. Ed. 2d 202 (1986)). The evidence and all reasonable inferences therefrom must be construed in the light most favorable to the non-moving party. Matsushita Elec. Indus. Co., Ltd. v. Zenith Radio Corp., 475 U.S. 574, 587, 106 S. Ct. 1348, 89 L. Ed. 2d 538 (1986); Redding, 241 F.3d at 532 (6th Cir. 2001). “[T]he mere existence of some alleged factual dispute between the parties will not defeat an otherwise properly supported motion for summary judgment; the requirement is that there be no genuine issue of material fact.” Anderson v. Liberty Lobby, Inc., 477 U.S. 242, 247-48, 106 S. Ct. 2505, 91 L. Ed. 2d 202 (1986) (emphasis in original); see also National Satellite Sports, Inc. v. Eliadis, Inc., 253 F.3d 900, 907 (6th Cir. 2001). [*7]

If the movant establishes by use of the material specified in Rule 56(c) that there is no genuine issue of material fact and that it is entitled to judgment as a matter of law, the opposing party must come forward with “specific facts showing that there is a genuine issue for trial.” First Nat’l Bank v. Cities Serv. Co., 391 U.S. 253, 270, 88 S. Ct. 1575, 20 L. Ed. 2d 569 (1968); see also McLean v. 988011 Ontario, Ltd., 224 F.3d 797, 800 (6th Cir. 2000). Mere allegations or denials in the non-movant’s pleadings will not meet this burden, nor will a mere scintilla of evidence supporting the non-moving party. Anderson, 477 U.S. at 248, 252. Rather, there must be evidence on which a jury could reasonably find for the non-movant. McLean, 224 F.3d at 800 (citing Anderson, 477 U.S. at 252).

ANALYSIS

Kreb Cycle asserts in its motion that it is entitled to judgment as to all three of plaintiff’s claims: negligence, gross negligence, and breach of warranty. In response, plaintiff asserts it is “only relying on the implied warranty of fitness and merchantability as to this Defendant and will not, therefore, respond to [*8] Defendant’s arguments as to negligence and gross negligence.” Accordingly, judgment is hereby granted for Kreb Cycle as to plaintiff’s negligence and gross negligence claims.

The sole claim remaining as to this defendant is plaintiff’s breach of warranty claim. Plaintiff concedes defendant made no express warranty regarding this helmet. Accordingly, proceeding on a cause of action for breach of an implied warranty, plaintiff asserts that she has established a prima facie case of breach of implied warranty under Michigan law, 3 citing to this court’s case of Konstantinov v. Findlay Ford Lincoln Mercury, 2006 U.S. Dist. LEXIS 85836, 2006 WL 3299487. As set forth in that case, under the Michigan Tort Reform Act, effective in 1996,

(6) In a product liability action, a seller other than a manufacturer is not liable for harm allegedly caused by the product unless either of the following is true:

(a) The seller failed to exercise reasonable care, including breach of any implied warranty, with respect to the product and that failure was a proximate cause of the person’s injuries.

(b) The seller made an express warranty as to the product, the product failed to conform to the warranty, and the [*9] failure to conform to the warranty was a proximate cause of the person’s harm.

Mich. Comp. Laws Ann. § 600.2947(6).

Defendant’s argument for summary judgment on this claim is that plaintiff has not come forward with any evidence of a specific defect in the helmet, and has not drawn any kind of causal connection between the alleged defect and her head injuries. It cites to Mascarenas v. Union Carbide, 196 Mich. App. 240, 249, 492 N.W.2d 512 (1992) for the elements of a product liability case under Michigan law: proof that the defendant supplied a defective product, and that the defect proximately caused the plaintiff’s injury. Defendant argues that plaintiff relies only on the helmet’s later recall, disclosed in a 5/22/03 CPSC press release (stating that the recall was occurring “in voluntary cooperation with” the U.S. distributor) and conclusory statements [*10] by an expert, neither of which establish a question of material fact as to proximate cause. 4

4 Defendant also addresses plaintiff’s weak assertion, in answers to interrogatories, that defendant “had a duty to determine whether the model helmet in question did in fact meet CPSC standards.” As defendant argues, there is no such duty required by Mich. Comp. Laws Ann. § 600.2947(6), set forth above.

The court agrees with the defendant. Although precedent such as Mills v. Curioni, Inc., 238 F. Supp. 2d 876, 886 (E.D. Mich. 2002) and the very recent decision in Coleman v. Maxwell Shoe Co., 475 F. Supp. 2d 685, 2007 U.S. Dist. LEXIS 11513, 2007 WL 551608 (E.D. Mich. 2007) lend support to defendant’s argument concerning non-manufacturing sellers and the need for a showing of negligence in failing to detect a product’s defect, this case must be dismissed whether or not such evidence is required.

Plaintiff’s expert’s initial report, created by Tyler A. Kress, Ph.D. in Knoxville, Tennessee, dated [*11] October 6, 2006, summarily lists plaintiff’s injuries following the accident. It then lists all of the expert’s qualifications, his fees, and the records he reviewed. These are a 9/26/2002 CT scan of plaintiff’s head; the hospital’s discharge summary; a letter of April 3, 2003 by a Jon Wardner, M.D. stating plaintiff’s disability; the CPSC announcement of the helmet recall; and the plaintiff’s deposition. Dr. Kress also states that he met with the plaintiff. The remainder (and the entire substance) of his letter/report stated only a conclusion that a “defect” of the helmet was “directly related to the inadequacies of the Catlike Kompact bike helmet.”

Defendant then brought a motion, granted by the magistrate, for sanctions and to require a supplemental report by November 15, 2006, containing a “complete statement of all opinions to be expressed and the basis and reasons therefor…” A supplemental report was subsequently created by Dr. Kress. That report, dated November 15, 2006, is set forth below in its entirety:

Dear Mr. Katkowsky:

This is to supplement my report of October 6, 2006, regarding the above-styled cause.

1) Use: It is my opinion that it is foreseeable [*12] that some consumers will sustain a preventable head injury due to the impact performance (or lack thereof) of the helmet while using it in an appropriate manner as it is intended to be used.

Protective head gear and bicycle helmets have the ability to eliminate or greatly reduce traumatic head and brain injury when properly designed an manufactured. To ensure that bicycle helmets available in the consumer market adequately serve these goals, the Consumer Product Safety Commission has created safety standards for a range of criterion, including impact attenuation (CPSC’s Safety Standard for Bicycle Helmets Final Rule: 16 CFR Part 1203).

Bicycle helmets that have adequate impact attenuation performance, as set forth by the CPSC’s safety standards, and are used in an appropriate, reasonable, and correct manner are highly successful in preventing or greatly reducing traumatic head and brain injury. As found in a 1989 study by Thompson et al and explicitly cited in the CPSC’s Safety Standard for Bicycle Helmets Final Rule (16 CFR Part 1203, pg. 11713), riders with helmets had an 85% reduction in head injury risk, and 88% reduction in brain injury risk.

2) Reason for Injury: [*13] Ms. Jenish’s head injury is directly related to the inadequacies of the Catlike Kompact bike helmet.

The CPSC’s Safety Standard for Bicycle Helmets Final Rule (16 CFR Part 1203) explicitly establishes a performance test to “ensure that helmets will adequately protect the head in a collision” (pg. 11714). As a component of this performance test, helmets are required to not exceed a peak headform acceleration of 300 g for any impact. This pass/fail criterion of 300g or below is consistent with other standards such as the ANSI, Snell, and ASTM (CPSC’s Safety Standard for Bicycle Helmets Final Rule (16 CFR Part 1203, pg. 11714; Halstead 2001). The Catlike Kompact bike helmet is inadequate due to the fact that it failed impact standards that pertain to the design and performance of the helmet in a foreseeable use that may result in an impact to the head.

In the accident on September 26, 2002, Ms. Jenish hit a curb while riding her bicycle, was ejected, and impacted her head. She reported a loss of consciousness at the scene, and her relevant injuries include, but are not limited to, a traumatic brain injury and a subdural hematoma. Ms. Jenish sustained a direct impact to the back [*14] of the head (occipital region) which corresponds to a right occipatal scalp hematoma and the area of impact and failure seen in the helmet. Contact head impacts, such as this, result in predominantly linear acceleration of the head and brain, with small components of angular acceleration. Linear acceleration can product focal brain injuries, such as subdural hematomas, as well as concussions; as seen in Ms. Jenish.

The severity of the head injury sustained by Ms. Jenish is a direct result of the inability of the Catlike Kompact to comply to the CPSC’s safety standards. Subdural hematomas, similar to the one sustained by Ms. Jenish, are commonly caused by an impact to the occipital region (Kleiven 2003, Zhou et al 1995). The acceleration of the head in an occipital impact exceeded the values of what a reasonably designed and protective headgear would have given the wearer. Due to the failure of the Catlike Kompact bicycle helmet to comply to the CPSC’s impact safety standards Ms. Jenish’s head experienced higher acceleration values resulting in a more serious traumatic brain injury than would have been experienced if the helmet was compliant with the impact standards of the CPSC. 3) Design Defect: The helmet is inherently dangerous and defective by design in that it fails to comply with impact testing standards required under CPSC’s safety standard for bicycle helmets, violating the Consumer Product Safety Act.

The impact attenuation standards of the CPSC’s Safety Standard for Bicycle Helmets Final Rule (16 CFR Part 1203) was created in order to “ensure that helmets will adequately protect the head in a collision” (p. 11714). Failure to meet this standard endangers consumers by failing to prevent or reduce injury.

Defendant contends that all this report arguably establishes is that the helmet failed to “meet standards;” and that plaintiff has failed to connect that alleged, undefined defect to her injuries. As defendant asserts, there is no evaluation of items such as plaintiff’s speed at the time of the crash, location of impact, descriptive information concerning the object struck or other details of the accident. Defendant [*16] points to the serious injuries sustained by the plaintiff in the crash, including fractured vertebrae, a crushed rib cage, fractured collarbone, bulging spinal discs, and a collapsed lung, and asserts that helmets don’t rule out any and all head injuries, in any crash or at any speed, but serve to help protect against head injuries. Plaintiff has not identified the manufacturing or design elements of the helmet that led to voluntary recall nor has accident reconstruction tied these elements to the plaintiff’s injuries.

As discussed at oral argument, plaintiff has not brought forth any evidence of the reason the Catlike Kompact helmet failed impact testing. 5 All that has been presented is a one page press release from the CPSC, set forth above, including a statement that “[t]he helmets fail impact testing required under CPSC’s safety standard for bicycle helmets, violating the Consumer Product Safety Act.” Without additional information from the CPSC or any other source, or the results of any independent testing, it is the opinion of the court that Dr. Kress’ statement that “[t]he severity of the head injury sustained by Ms. Jenish is a direct result of the inability [*17] of the Catlike Kompact to comply to the CPSC’s safety standards” can be nothing but inadmissible speculation. Accordingly, it is the court’s determination that plaintiff has not produced evidence to raise a question of material fact regarding causation. Defendant’s motion will be granted.

5 Plaintiff has failed to identify any specific claimed defect, such as deficiencies in the suspension or cushioning system, hardness or thickness of the plastic, ventilation engineering, overall shape, the strapping mechanism, or any other particular aspects of the helmets in general, much less the helmet worn by plaintiff. Without knowing the defect that motivated a voluntary recall, and without testing of the helmet worn by plaintiff, it is impossible to conclude that a defect caused her injury.

CONCLUSION

Because plaintiff has failed to raise a question of material fact as to the proximate causation of her head injuries by an alleged defect in her bicycle helmet, summary judgment will enter as to all claims brought [*18] by the plaintiff against this defendant.

The Outdoor Recreation Retail Store: Liability IssuesBSA On The Go

Retailers are faced with a myriad of problems today. Liability should not be one of them. When looking at a new product at OR the retailer needs to understand whether or not that product can be brought into a store and the issues. Once in a store the retailer needs to understand the disclaimer language on the product and how that needs to be dealt with. Next the retailer must understand any issues in selling the product. A new issue that retailers are going to face is a continuing duty to warn of issues after the sale. Between this new liability issue and recalls either mandated by the CPSC or voluntary, the retailer can be stuck between a rock and hard place or left holding the bag. At the same time, understanding the new duty can create an opportunity to collecting additional information from customers and market to them post sale. Renting outdoor product is always an issue. What information must go with the product when it is rented? What cannot be rented? (Nothing, as long as there is Hertz, we can rent stoves.) What should you do if you are named in a lawsuit?

Study shows that head injuries are on the rise on the slopes even though more people are wearing helmets

A study presented at the American College of Emergency Physicians(ACEP) showed that even with the increased use of helmets on ski slopes head injuries had

increased. Overall injuries on the slopes have remained constant during the same period of time.

The study was based on a review of reports to the U.S. Consumer Product Safety Commission‘s National Electronic Injury Surveillance System (NEISS) Overall helmet use increased from 36.7% to 57.99% during the study period.

The study looked at 68,761 head injuries during the 2004 through 2010 ski seasons. Males represented 68.8% of the injuries, snowboarders 57.9%, and riders between the ages of 11-017 representing 47.7%.

The one difference in the study was children under 10 years old, which showed a decrease in hade injuries dropping from 11.7% to 4.6%.

One brought out by the study was helmets are only good for impacts of 12-15 miles per hour. Most people ski and board faster than that. The true value of a helmet, 12-15 mph of impact protection should be put out there so more people understand what a helmet will and will not do. People are sold helmets with the idea that they will prevent head injuries. They only will prevent injuries in that narrow range of 0-15 mph; over that speed, you probably are going to have an injury.

There were two different ideas put forth as two why head injuries increased. The one idea with the least space about it was Risk Homeostasis or Target Risk. The other was:

My assumptions are that those increases parallel the increase in terrain park use and the level of difficulty and risk in these sports over the last decade,” Christensen said, “and also that we’re simply seeing more people reporting head injuries because there’s been more education and awareness around them.

However, Risk Homeostasiswill also support the greater use of terrain parks and the increased level of difficult and increased risk undertaken by skiers and riders.

Do Something

If you sell helmets tell people the truth. Helmets will reduce some head injuries. Helmets probably will not save your life because if you hit something hard enough to cause brain damage that a helmet will protect you from; you are going to receive other injuries that may kill you.

If you wear a helmet understand what your helmet will and will not do to protect your head.

Utah Rental Release void because the product was subject to recall

Jozewicz v. GGT Enterprises, LLC; 2010 U.S. Dist. LEXIS 53937

The public policy exception allows the release to be void when the recalled product was not pulled from the rental fleet.

This is a Utah ski rental case. The plaintiff rented skis from the defendant. While skiing, the plaintiff fell injuring her neck. She claimed she fell because the bindings prematurely released. The bindings were manufactured by K2 a subsidiary of the Jarden Corporation.

Prior to the plaintiff’s injury, K2 had notified the Consumer Product Safety Commission and issued a recall for the bindings the plaintiff was using. The recall was based due to a tendency for the bindings to unexpectedly release. The recall was issued by the CPSC and K2 had sent notice of the recall to retail and rental shops.

The plaintiff filed this suit in federal court against the defendant rental shop and the binding manufacture K2. The defendant rental shop filed this motion to dismiss because the plaintiff had signed a release when she rented the recalled skis and bindings.

Summary of the case

The defendant rental shop filed a motion for summary judgment because the plaintiff had signed a release upon renting the skis and bindings. The court first looked at releases and Utah’s law and found Utah allows people to “contract away their rights to recover in tort for damages caused by the ordinary negligence of others.” Under Utah’s law, there are three exceptions that can void a release when:

(1) the release offends public policy,

(2) the release is for activities that fit within the public interest exception, or

(3) the release is unclear or ambiguous.

The court found that the second and third exceptions were not at issue here. The first issue, that releases must be compatible with public policy under Utah’s law. The court looked at the public policy exception to the rule slightly different in Utah than in most other states that allow a release to be voided due to public policy issues.

The court looked at the federal law that created the Consumer Products Safety Commission and created the requirement that products be recalled.

Under 15 U.S.C. § 2064(b), manufacturers, distributors, and retailers are required to notify the United States Consumer Product Safety Commission when they become aware a product (1) fails to comply with applicable safety standards, (2) fails to comply with other rules, regulations, standards, or bans under any acts enforced by the Commission, (3) “contains a defect which could create a substantial product hazard,” or (4) “creates unreasonable risk of serious injury or death.”

The court then stated: “The law requires distributors and retailers to heed recall alerts issued by the Commission and ensure defective products are either fixed or not sold.” Finding this requirement puts an extreme burden on shops, retail or rental when dealing with recalled products.

The rental shop argued that the federal law cannot preempt state law, and state law allows releases. The court agreed, however, the court stated the law did not conflict or preempt the Utah law.

The court went on to say.

The rental of the ski bindings at issue in this case became unlawful once the recall notice became effective. Public policy should not favor allowing a party to insulate itself from harms caused to others arising from unlawful acts.

The said that if a release relieved the retailer of the duty to recall products, then the effect of the law would be nullified and would violate the value of the law. Public policy issues should encourage compliance with laws designed to make products safer not void them.

The court held the rental companies arguments were not valid and denied the motion for summary judgment.

So Now What?

If you get a recall notice, and you are in a retail store, rental shop, or distributor, remove the product from the shelves and/or the rental fleet. Period. The judge in his final sentence stated: “GGT’s preinjury release is unenforceable and invalid as a matter of public policy.” There is no leeway in that statement.

This may create disaster in a small rental shop. Most times the shop has one binding on all of its skis. It makes setting the bindings easier and makes training the employees on setting the bindings much easier also.

It can be a scary situation when you open an email and find you have no rental fleet. You should contact the company immediately and tell them that you are out of business effectively unless they respond and assist you in correcting the entire recalled product or replacing it.

This may be an issue you want to discuss with someone when you are negotiating bindings for your rental fleet.

Product recalls are not minor matter. Any product you have in your store that is subject to a recall is no longer available for sale until after the product has been fixed according to the manufacture’s requirements.

MEMORANDUM DECISION AND ORDER

INTRODUCTION

While skiing at Alta ski area, Plaintiff Laura Jozewicz (“Jozewicz”) fell and injured her neck. Jozewicz contends she fell because the binding on her skis unexpectedly released due to a product defect. Jozewicz rented the skis from Defendant GGT Enterprises, LLC (“GGT”). At the time of rental, a recall notice was in effect for the binding, but GGT did not remove the product from its rental inventory. Nevertheless, GGT seeks dismissal of Jozewicz’s negligence claim on the basis that she signed a release from liability at the time she rented [*2] the skis. For the reasons discussed below, the court denies GGT’s motion to dismiss.

FACTUAL BACKGROUND

On March 17, 2008, GGT rented skis to Jozewicz. On March 18, 2008, Jozewicz fell and injured her neck while skiing at Alta ski area. Jozewicz claims her fall occurred when the Marker MI Demo binding on her rental ski released unexpectedly. Jozewicz alleges that Defendants K2 Corporation and Jarden Corporation (collectively “K2/Jarden”) manufactured the ski binding. Prior to Jozewicz’s fall, K2/Jarden notified the United States Consumer Product Safety Commission (“Commission”) regarding the binding, and the Commission subsequently issued a recall alert on May 30, 2007, due to “Unexpected Release, Fall Hazard.” 1 The recall alert stated that “[s]ki shops with these bindings in their rental inventory should not rent this equipment to consumers until it has been upgraded.” 2 The recall further stated that “[s]kiers can unitentionally displace a lever at the rear of the binding,” which “[i]f it is fully displaced, . . . can result in the unexpected release of the binding and possibly cause the user to fall.” 3

Prior to renting her [*3] skis from GGT, Jozewicz signed an “Equipment Rental and Liability Release Agreement,” which states in relevant part:

I understand that the binding system cannot guarantee the user’s safety. In downhill skiing, the binding systems will not release at all times or under all circumstances where release may prevent injury or death, nor is it possible to predict every situation in which it will release. . . .

I understand that the sports of skiing, snowboarding, skiboarding, snowshoeing and other sports (collectively “RECREATIONAL SNOW SPORTS”) involve inherent risks of INJURY and DEATH. I voluntarily agree to expressly assume all risks of injury or death that may result from these RECREATIONAL SNOW SPORTS, or which relate in any way to the use of this equipment. . . .

I AGREE TO RELEASE AND HOLD HARMLESS the equipment rental facility, its employees, owner, affiliates, agents, officers, directors and the equipment manufacturers and distributors and their successors in interest (collectively “PROVIDERS”), from all liability for injury, death, property loss and damage which results from the equipment user’s participation in the RECREATIONAL SNOW SPORTS for which the equipment is provided, or [*4] which is related in any way to the use of this equipment, including all liability which results from the NEGLIGENCE of PROVIDERS, or any other person or cause.

I further agree to defend and indemnify PROVIDERS for any loss or damage, including any that results from claims or lawsuits for personal injury, death, and property loss and damage related in any way to the use of this equipment. 4

GGT claims the release agreement bars Jozewicz’s negligence claim.

ANALYSIS

I. STANDARD FOR REVIEW

Defendant GGT brings this motion under Federal Rule of Civil Procedure 12(b)(6). When considering a 12(b)(6) motion, “a court must accept as true all well-pleaded facts, as distinguished from conclusory allegations, and those facts must be viewed in the light most favorable to the nonmoving party.” 5 The complaint must include “enough facts to state a claim to relief that is plausible on its face.” 6 “The court’s function on a Rule 12(b)(6) motion is not to weigh potential evidence that the parties might present at trial, but to assess whether the plaintiff’s complaint alone is legally sufficient to state a claim [*5] for which relief may be granted.” 7 Consequently, a court does not look at evidence outside of a pleading to determine such motions. 8 If a court does rely “on material from outside the pleadings, the court converts the motion to dismiss into a motion for summary judgment.” 9 Because the court relies on material outside of the pleadings in this case, the court converts this motion into a motion for summary judgment.

II. PREINJURY RELEASES

A. Limitations on Preinjury Releases

Without question, individuals “may contract away their rights to recover in tort for damages caused by the ordinary negligence of others.” 10 The Utah Supreme Court has recognized, however, “that preinjury releases are not unlimited in power and can be invalidated in certain circumstances,” including when (1) the release offends public policy, (2) the release is for activities [*6] that fit within the public interest exception, or (3) the release is unclear or ambiguous. 11 The second limitation is not at issue here because “preinjury releases for recreational activities,” such as skiing, “cannot be invalidated under the public interest exception.” 12 Likewise, the third limitation is not at issue because Jozewicz conceded during oral argument that the release is not unclear or ambiguous. Thus, the prevailing issue in this case is whether a public policy concern overwhelms the effect of the preinjury release that Jozewicz signed.

B. Public Policy Considerations

Preinjury releases must be compatible with public policy to be enforceable. 13 Previously, the Utah Supreme Court has invalidated preinjury releases when they were contrary to public policy set forth in statutory provisions. The court has recognized that “[w]hen . . . the Legislature clearly articulates public policy, and the implications of that public policy are unmistakable, we have the duty to honor those expressions of policy in our rulings.” 14 Thus, in Hawkins v. Peart, the [*7] Utah Supreme Court held that public policy invalidated a preinjury release signed by a parent on behalf of a minor child. 15 The court looked to Utah statute and found that it “provides various checks on parental authority to ensure a child’s interests are protected.” 16 In particular, it found that when a child is injured, statutory law precludes a parent from settling a claim, unless the parent is appointed as conservator for the child. 17 Based on this clear legislative intent to protect a minor’s interest post injury, the court concluded that a preinjury release for a minor child likewise was unenforceable. 18

As applicable to this case, Congress has expressed its concern about product defects that pose a significant risk of injury or death. In an effort to protect the public from such defects, it enacted the Consumer Product Safety Act (the “Act”). The stated purpose of the Act is:

(1) to protect the public against unreasonable [*8] risks of injury associated with consumer products; (2) to assist consumers in evaluating the comparative safety of consumer products; (3) to develop uniform safety standards for consumer products and to minimize conflicting State and local regulations; and (4) to promote research and investigation into the causes and prevention of product-related deaths, illnesses, and injuries. 19

Through this legislation, Congress has stated its intent to create laws that protect the public from unreasonable risk of harm from defective products and to provide a uniform regulatory scheme to promote product safety.

Under 15 U.S.C. § 2068, manufacturers and distributors are charged with honoring the recall alerts issued by the Commission. The law in effect at the time of Jozewicz’s accident stated:

It shall be unlawful for any person to —

(1) manufacture for sale, offer for sale, distribute in commerce, or import into the United States any consumer product which is not in conformity with an applicable consumer product safety standard under this chapter;

(2) manufacture for sale, offer for sale, distribute in commerce, or import into the United States any consumer product which has been declared a banned hazardous product by a rule under this chapter. 21

Section 2068(a) now prohibits the sale, manufacture for sale, distribution, or importation of any product (1) “that is not in conformity with an applicable consumer product safety rule,” (2) that is subject to a voluntary corrective action, (3) that is an imminent hazard and subject to a Commission’s order, or (4) that is a banned hazardous substance. Id. § 2068(a)(1)-(2) (2010).

Congress enacted the statute to ensure [*10] safe products are provided to the public and to limit the risk of injury. Once a manufacturer, distributor, or retailer reports a defect to the Commission and a recall alert is published, the alert would have no effect if other retailers were not required to take action to correct the defect or remove the product from their inventory. The law requires distributors and retailers to heed recall alerts issued by the Commission and ensure defective products are either fixed or not sold.

Jozewicz argues that Congress’s public policy concern to prevent unreasonable risk of serious injury or death to the public meets the public policy standard set forth by the Utah Supreme Court, and therefore invalidates her release of GGT’s negligence. GGT contends, however, that Congress did not intend for the Consumer Product Safety Act to preempt state law, and no private cause of action exists under 15 U.S.C. § 2064(b). While this is true, this does not nullify the stated public policy concerns that override the right of parties to contract away tort liability. The rental of the ski bindings at issue in this case became unlawful once the recall notice became effective. Public policy should not favor [*11] allowing a party to insulate itself from harms caused to others arising from unlawful acts. Moreover, a decision that public policy causes a preinjury release to be invalid in this case does not cause GGT to be held liable under the Act, nor does it preempt state law. It merely recognizes Congress’s concern to minimize unreasonable risk to the public of serious injury or death. Such a concern is particularly relevant when a latent defect exists of which distributors and retailers are or should be aware, but not a consumer.

The implication of allowing distributors and retailers to contract away liability for noncompliance with established safety standards would increase the risk of injury and would be contrary to Congress’s express public policy concerns. Furthermore, validating the release of liability for noncompliance with Federal law would effectively reduce or eliminate the responsibility that distributors and retailers have to make sure the products they sell or rent are safe. Public policy should encourage compliance with safety laws, not disregard for such laws. Due to a strong public interest in ensuring adherence to recall alerts, the court concludes that GGT’s release is unenforceable [*12] as a matter of public policy.

CONCLUSION

GGT’s preinjury release is unenforceable and invalid as a matter of public policy. For this reason, GGT’s motion is DENIED. 22

Helmets: why cycling, skiing, skateboarding helmets don’t work

A helmet needs to absorb energy to work. The more energy a helmet absorbs the more protection a helmet provides. If you look at the inside of your helmet

what is there to absorb energy?

A helmet does not work by being a hard surface to protect your head from head injuries. Hard surfaces protect your head from pointed objects. Think Knights of the Round Table and spears and arrows. If you are riding a bike or skiing and someone is shooting arrows at you, you need a hard helmet.

Hitting the ground is different. Your brain bounces around inside your skill causing damage; a concussion. You need something to absorb the impact and soften the blow or extend the time the impact (force) is being applied to your head, which softens the blow. Helmets as they are currently used, do not do that.

Think about the issue this way. If you drop a weight on an egg, say 11 pounds from 4 feet the egg is going to smash. If you put a book on top of the egg and drop the 11-pound weight the egg is still going to smash. The amount of energy transmitted to the egg maybe reduced by the book; however, the energy reduction is not enough to protect the egg.

A Bicycle or ski helmet is the same way. There is some energy absorption, but not enough to protect your brain.

If you want to know why I picked 11 pounds from 4 feet that is the test for helmets. Watch Video of cycling helmet testing. No one is testing the force on the head, if the helmet absorbs any of the force, or if the impact broke your neck.

On top of that, always remember the helmet is tested with the impact landing in the center top of the helmet. When you fall to make sure you drive your head into the ground hitting the helmet in the center on top of your head to receive the maximum protection.

This test is for climbing and some European ski helmets. In the US, a bike helmet and ski helmets are not tested for lateral force, slippage or chin strap strength.

There are some organizations that test the helmets to greater extremes such as Consumer Reports, but all they are doing is testing the helmet. They are not looking at whether the helmet protects your head. See Consumer Reports Bike Helmet Testing.

We are not testing whether a helmet looks good after an impact. We are testing whether the helmet protects your head from an impact and the drop test does not test that sufficiently, if at all.

If you want to test this yourself, figure a way to stick an egg under a helmet and drop a weight on the helmet. The egg is still going to crack or break.

Yes, your head is not an egg. It is just easier to see the results with an egg. The helmet did not decrease the pressure enough to protect the egg. The injury still occurred. If you could take the time to measure the breaking strength of an egg and then start below that number and drop weights on the helmet you would see a difference eventually which would be the amount of protections the helmet provides. However, that number would be small and probably no different from what a plastic bowl would do.

If you really want to test this, go buy two eggs.  Drop one from 15 feet and see what happens to the egg. Tape the other one in your helmet and drop it from the same height. The egg will crack (and make a real mess in your helmet).

Yes, your head is not an egg. Yes, a helmet will protect you from minor hits. Yes, a helmet is probably better than not using a helmet, unless the process stops you from riding a bike or skiing. The health benefits of activity out weight the risk of a head injury.

If that is the case, then why not wear a helmet when you drive, shower or work in the kitchen. All three have a far greater risk of head injuries then cycling.

However, we have not looked at whether using helmets deters activities. See TEDxCopenhagen – Mikael Colville-Andersen – Why We Shouldn’t Bike with a Helmet. I love the fact the in the video Mr. Colville-Andersen lets you know that the helmet tests were designed for pedestrians wearing helmets. Also he points out that helmet laws do not reduce head injuries. They reduce the total number of people riding bikes, which results in a reduction of head injuries.

Nor have we looked at the issue of the advertised protection versus the real protection afforded by a helmet.

Finally, we have not looked at whether wearing a helmet makes you react in a way to protect other parts of your body rather than your head. If you fall you natural protect your head. Your arms go out to keep your head form hitting the ground and then your cradle your head from being hit or hitting the ground. This accounts for tons of videos and statements when people hold up their battered helmet and say my helmet saved my life.

But without bike and ski helmets where would we mount our video cameras?

Do you really want to sell helmets this way? Does this article promote the industry?

Or does this article just create liability issues?

I recently read an article in a trade magazine about selling cycling helmets. As usual, it caught my attention, but for different reasons. This article was directed at retailers as an educational tool on how to sell helmets. However, the article was at best misleading and would probably get the retailer in trouble in the future. Besides, it created a sales program focused on the negative side of cycling rather than the benefits.

Here are the quotes that I found amusing, actually laughable if they were not so wrong.

According to the Insurance Institute for Highway Safety (IIHS), 91% of bicyclists killed in 2009 weren’t wearing helmets. The IIHS has estimated that wearing a helmet can reduce head injuries by 85%.

In the United States the Consumer Product Safety Commission (CPSC) regulates helmet law.

Seriously? This was written let alone allowed into print?

However, it was the hocus pocus of a graph in the article that caught my eye.

And so on through 2009.

The title implies the deaths occurred because cyclists did not wear a helmet. If you take two unrelated numbers and compare them, you can accomplish anything. For proof of this do a web search for “moon landings,” “Kennedy assignation,” and “World trade center,” for an interesting journey through made-up  statistics to prove this point. Here they point out who died without a helmet compared to who died wearing a helmet and imply that everyone who died without a helmet died of a head injury.

Absolute fabrication of statistics to scare people!

Helmets prevent head injuries; helmets don’t save lives. If you are involved in an accident severe enough that a head injury will kill you, other parts of your body will be injured severely enough to kill you.

So let’s tackle these misstatements in the article.

As a bike storeowner, this gives you both an incredible opportunity – and a powerful responsibility – to upsell your bike customers and convince them to purchase a helmet and perhaps save a life.

As a retailer you have NO legal responsibility to your customers as far as educating them. You DO have a legal responsibility to educate them correctly if you do educate them. Whether or not you have a moral or ethical responsibility is something you must deal with and a risk you must accept. That risk evaluation also includes losing money by not selling accessories like helmets. However, it is shameful for this article to try to place a burden on a retailer for not selling a helmet.

Helmets do not save lives; helmets may prevent head injuries.

It’s your responsibility to inform your customers of the invaluable protection a helmet provides, the importance of wearing a safe helmet that fits well, as well as the dangers and statistics of cycling-related head injuries.

What is a “safe helmet?”

If you are going to use statistics to prove your point, then you better understand what you are saying. You cannot take two “stats” and compare them to prove a point when the numbers are derived from different sources or different factors. (A perfect example of this is the chart that went with the article).

According to the Insurance Institute for Highway Safety (IIHS), 91% of bicyclists killed in 2009 weren’t wearing helmets. The IIHS has estimated that wearing a helmet can reduce head injuries by 85%.

Just because a large percentage of people died who were not wearing a helmet does not mean you can then say those people died of a head injury. That is like saying 97% of the people in the US who eat ice cream do not get cancer. Only three percent of the population gets cancer anyway.  However, that statistic is 100% correct and 100% meaningless, just like the statistics in the article. (However, you can use this statistic to eat more ice cream if you want.)

In the United States, the Consumer Product Safety Commission (CPSC) regulates helmet law.

This is the second time I’ve seen this in the past couple of months. NO! The CPSC is tasked with eliminating dangerous products. If a helmet is not doing what you say it is supposed to do AND there is the possibility of injury, then the CPSC can become involved. There are no federal helmet laws. The CPSC is a federal agency. There are some state helmet laws and some federal regulations concerning helmets. Those regulations are all based on a product meeting the tests of either a testing organization (ASTM, ANSI, etc.) or private non-profit organizations that test helmets (Snell).

These numbers also lead one to believe the people died because the cyclist was wrong and not wearing a helmet. However, that is not true either. Cyclists die when vehicles hit them. If the speed of impact is greater than 30 to 40 mph, the cyclists have almost a zero chance of surviving the impact. (See Zone 30 and Pedestrian and Bicyclist Intersection Safety Indices.) Distracted drivers, drivers not paying attention, drivers who don’t care kill cyclist with or without a helmet. See Sharing the Road With Bicycles for more examples.

Do Something

Why is this important? Because consumers do trust and believe retailers as the article points out. If you provide consumers with information which they rely upon in making a purchase which is incorrect and results in an injury you are liable. The manufacturer is going to walk away from this lawsuit without paying a dime. This is a lawsuit the retailer alone must fight.

The retailer made a misstatement that the consumer relied upon to the consumer’s detriment.

This helmet will save your life. The cyclists die of a head injury, and the retailer is writing a check.

You have to educate the consumer; however, when you do that you need to know what is correct. You cannot give the consumer incorrect information. You need to tell the consumer helmets prevent head injuries. No one knows, and there is zero proof that helmets save lives. In fact, the opposite is true. Looking at injury and fatality reports, helmets do nothing to save lives.

What is bad about this article is the fact the article was written by a helmet manufacture and published by an industry magazine. The magazine failed its readers because it published an article without checking the facts in the article. The manufacture that wrote the article is selling helmets based on made-up  statistics and facts to promote fear.

Cheap journalism is bad journalism.

On top of that are we helping cycling? If you are trying to sell a helmet to someone based on fear, are we helping the sport? Or are we telling parents that cycling is too dangerous for their kid? Is that how you want to sell cycling; this is a dangerous sport, so spend another $100 with me?
